VICTORIA PARK NO. 4

DECLARATION OF
COVENANTS, CONDITIONS AND RESTRICTIONS

THIS DECLARATION, made this 1st day of March, 1979 by VALLEY CEMENT CONSTRUCTION, INC., a corporation, hereinafter referred to as Declarant,

W I T N E S S E T H:

WHEREAS, Declarant is the legal and beneficial owner of certain real property described as follows:

WHEREAS, Declarant will convey certain of the said properties subject to certain protective covenants, conditions, restrictions, reservations, liens and charges as hereinafter set forth; and

WHEREAS the above described property has been accepted into the Victoria Park Homeowners Association, Inc.;

NOW THEREFORE, Declarant hereby declares that the property described in hereinabove shall be held, sold and conveyed, subject to the easements, restrictions, reservations, charges, liens, covenants and conditions as contained in the Declaration of Covenants, Conditions, and Restrictions of Victoria Park No's 1, 2, and 3, as recorded under King County Auditor's File No. 6388371. All of the covenants, conditions and restrictions contained in said Declaration are incorporated herein by this reference, all for the purpose of enhancing and protecting the value, desirability and attractiveness of the above-described real property. These easements, restrictions, reservations, charges, liens, covenants and conditions shall run with the real property and shall be binding on all parties having or acquiring any right, title or interest in the described properties or any part thereof, and shall inure to the benefit of each owner thereof.

ARTICLE I

DEFINITIONS

The definitions contained in Article I of the Declaration of Covenants, Conditions, and Restrictions of Victoria Park No's 1, 2, and 3, as recorded under King County Auditor File No. 6388371 are hereby incorporated by this reference.

The "common properties" of Victoria Park No. 4, for purposes of Section 5 of Article I of said Declarations are described as follows:

"Declarant", for purposes of Section 10 of Article I of said Declarations shall mean Valley Cement Construction, Inc.

ARTICLE II

PROPERTY SUBJECT TO THIS DECLARATION

The real property which is, and shall be held, transferred, sold, conveyed and occupied subject to this declaration, is located in King County, Washington and is described as follows:
